Definitions
These terms of sale (the “Terms”) are offered by VIRTUAVIA SARL, SARL with a share capital of 50 000 €, registered with RCS Grenoble 428 797 450, whose registered office is at 2 rue Marcel Benoit, 38000 Grenoble, France.
- Website: https://www.gyrophareled.fr and all its pages.
- Products: devices, accessories and equipment offered, including laser speed guns, speed display signs, alert systems, cases, tripods and batteries.
- Services: calibration, verification or support services provided by the Seller.
- Seller: VIRTUAVIA SARL.
- Customer: any natural or legal person placing an order or requesting a service.
- Consumer: any natural person acting for purposes outside their trade, business, craft or profession.
Any order or acceptance of a quote implies full acceptance of these Terms.
Article 1 – Purpose and scope
These Terms set out the conditions under which the Seller sells its Products and Services on the Website, on quotation, by e-mail or by any other agreed means. The Terms in force on the date of the order or acceptance of the quote apply; the Seller may amend them for future orders.
Article 2 – Products and Services
The essential characteristics of the Products and Services are presented on the Website, in technical documentation or in quotes. Photographs and illustrations are indicative: minor differences in appearance do not constitute a lack of conformity provided the essential characteristics are respected.
The Customer is responsible for checking that the Product is suitable for the intended use and that they are authorised to use it: the use of certain equipment (blue lights, reserved tones, speed enforcement) is regulated, and purchase does not constitute authorisation of use.
Article 3 – Quotes and orders
The Seller mainly serves government bodies, local authorities, police services, public organisations, businesses and professionals. Many orders are placed on quotation or by purchase order.
Orders on quotation. A quote request made on the Website is not a firm order. The order becomes final once the Customer accepts the quote: signature, “approved” mention, sending of an administrative or business purchase order, or any other means clearly establishing agreement. For public buyers, the order may take the form of a purchase order or legal commitment containing the invoicing information.
Online orders. Where a Product is offered for direct purchase, the Customer chooses the version, options and quantity, enters their details, checks the summary (price, shipping costs, VAT) and confirms the order by paying. The order is firm once payment is confirmed; a confirmation e-mail is sent to the Customer.
The Seller may refuse or suspend an order in the event of clearly incorrect or incomplete information, an unresolved previous dispute, unavailability, an obvious pricing error or any other legitimate reason; any amounts paid are then refunded in full.
Article 4 – Prices
Prices are shown in euros excluding VAT and shipping. The price including all taxes is shown before the order is confirmed. VAT is applied according to the delivery country:
- France and Monaco: French VAT at 20%;
- other EU member state, business Customer with a valid EU VAT number: reverse charge, invoicing without VAT;
- European Union without a valid VAT number: French VAT;
- outside the European Union: export exemption; customs duties, import taxes and clearance fees are payable by the recipient.
Transport, packaging, insurance, calibration or other additional costs are shown before confirmation or on the quote. The Seller may change its prices at any time; the applicable price is the one accepted at the time of the order or shown on the accepted quote.
Article 5 – Payment terms
The applicable terms are those stated on the quote, purchase order, invoice or, for an online order, at the time of confirmation.
1 – French administrative mandate – 30-day payment via Chorus Pro
French government bodies, towns, local authorities and public organisations may pay by administrative mandate, with no payment on ordering unless otherwise agreed. The order is processed on receipt of a purchase order or legal commitment identifying the buyer. After delivery or performance of the service, the invoice is sent electronically via Chorus Pro where applicable. The overall payment period is in principle 30 days from receipt of the invoice (or from completion of the service if later).
The public buyer provides the necessary information: purchase order or legal commitment number, SIRET number of the receiving department, Chorus Pro service code and any other useful reference.
2 – Bank transfer
Bank transfer is accepted for businesses, professionals and organisations. Bank details are shown on the quote or invoice. Unless otherwise agreed in writing, payment is due on ordering and preparation or dispatch may take place after the funds have been received.
3 – Online payment
For Products offered for direct purchase, the Customer pays on the Website by bank card (CB, Visa, Mastercard, American Express), Apple Pay, Google Pay, SEPA direct debit or any other method offered at checkout. Payment is processed by the secure provider Stripe; the Seller never stores card details. The amount is due on confirmation of the order. See the secure payment page.
The Customer warrants that they are authorised to use the chosen payment method.
Late payment by business Customers
Any amount not paid when due automatically incurs, without reminder, late-payment penalties equal to the most recent European Central Bank refinancing rate plus 10 percentage points, together with a fixed recovery fee of €40, without prejudice to further compensation.
Retention of title
Products remain the property of VIRTUAVIA SARL until full payment of the price, subject to mandatory provisions.
Article 6 – Delivery
Unless otherwise stated on the product page or quote, orders are prepared and dispatched within 5 to 7 working days by tracked transport. Lead times may depend on availability, preparation, verification or calibration and transport constraints. Details are set out in the shipping and delivery policy.
On receipt, the Customer checks the condition of the parcel. In the event of visible damage, they make specific reservations with the carrier and inform the Seller promptly. For Consumers, risk passes on physical possession of the Products; for businesses, on handover to the carrier, unless otherwise agreed.
Article 7 – Consumer right of withdrawal
Consumers have a statutory period of 14 days from receipt of the Product to withdraw, without giving a reason, in accordance with the French Consumer Code. They notify the Seller by a clear statement sent to VIRTUAVIA SARL, 2 rue Marcel Benoit, 38000 Grenoble, France or contact@virtuavia.com, then return the Product within 14 days of their decision. Direct return costs are borne by the Consumer.
The refund, including initial delivery costs, is made no later than 14 days after notification of withdrawal, using the same payment method; it may be withheld until the Product is received or proof of return is provided.
The right of withdrawal does not apply to purchases made by businesses or public bodies for the purposes of their activity, to Products made or configured to the Customer’s specifications, or in other cases excluded by law.

Article 8 – Returns and refunds
Details are set out in the returns and refund policy, which does not limit Consumers’ statutory rights.
Article 9 – Warranties
Consumers benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) for two years from delivery, and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). Remedies may include repair or replacement and, in some cases, a price reduction or cancellation of the contract.
Some Products also carry a commercial warranty stated on their page (for example two years for the ProLaser 4 in mainland France), without prejudice to the legal guarantees. For business Customers, the warranty is limited, at the Seller’s option, to repair, replacement or refund of a Product found to be defective. Damage resulting from impact, misuse, modification or third-party repair is excluded.

Article 10 – Calibration, verification and technical services
Calibration or verification services are carried out under the conditions stated on the Website, the quote or the documents provided. The Customer supplies complete, identified (model, serial number) and properly packed equipment, in its original case. Session dates are indicative unless expressly committed on the quote. Verification does not include repairs; any fault must be reported when requesting. The Seller cannot guarantee the continued performance of a device affected after its return by impact, misuse, modification or third-party repair.
Article 11 – Liability
The Seller is not liable for non-performance due to force majeure or an event reasonably beyond its control. The Customer uses the Products in accordance with their intended purpose, instructions, manufacturer recommendations and regulations. For business Customers, the Seller’s liability is limited to the amount of the order concerned and excludes indirect loss. These limitations do not apply where prohibited by mandatory law.
Article 12 – Intellectual property
The Website content and documentation provided remain the property of the Seller or its partners. Any unauthorised reproduction is prohibited.
Article 13 – Personal data
The data collected is necessary to process requests and orders. It is processed in accordance with the privacy policy.

Article 15 – Consumer mediation
In the event of a dispute, the Consumer first sends a written complaint to the Seller. Failing an amicable solution, they may refer the matter free of charge to le médiateur de la consommation dont relève VIRTUAVIA .
Article 16 – Governing law and disputes
These Terms are governed by French law. For Consumers, mandatory rules on jurisdiction apply. Between businesses, any dispute falls within the jurisdiction of the courts of the Seller’s registered office, unless a specific clause appears on the quote or purchase order.
Article 17 – Severability
If any provision of these Terms is held void or unenforceable, the other provisions remain fully in force.
